The victim was attempting to get onto Interstate 40 from Brevard Road when the man blew his horn at her and made an obscene gesture, police said. He reportedly hit the woman several times until she fell to the ground.
Asheville PD have identified and charged the suspect, and there is some question as to who he is.
According to N.C. Department of Corrections records, a (Suspect), 53, served more than 35 years in a Guilford County prison for robbery with a dangerous weapon.
Police Lt. Wally Welch said he could not confirm that these records were that of the man charged, but that police would not necessarily know the suspect’s records from other counties.
Here’s a lesson for you. You don’t know who that person is. Leave them alone if you can. If they approach you, leave if you can. If all else fails, pull out your legally carried handgun and end the threat.

(b) The lawful occupant of a home, motor vehicle, or workplace is presumed to have held a reasonable fear of imminent death or serious bodily harm to himself or herself or another when using defensive force that is intended or likely to cause death or serious bodily harm to another if both of the following apply:
(1) The person against whom the defensive force was used was in the process of unlawfully and forcefully entering, or had unlawfully and forcibly entered, a home, motor vehicle, or workplace, or if that person had removed or was attempting to remove another against that person’s will from the home, motor vehicle, or workplace.
Stay in your car. If he comes in after you, you know what to do. If you get out and confront the person, it’s mutual combat, and you can’t call it self-defense.
